  11. The following are the prepared remarks of Joe Phillips, Director of
  12. Federal  Affairs, NRA-ILA, on the issue of government violence and
  13. the need for a  national commission on BATF violence .

  23. When the National Rifle Association of America and other
  24. constitutional rights  organizations first joined together to urge
  25. that President Clinton establish a  national commission to
  26. investigate abuse of power on the part of federal law  enforcement
  27. agencies, the date was January 1993.
  28.  
  29. It is now January 1995.
  30.  
  31. The national commission on government violence is now two
  32. years too late for too many victims, and President Clinton is still
  33. not listening.
  34.  
  35. There is often disagreement between NRA and the American Civil
  36. Liberties Union,  another leading coalition member,  on a host of
  37. issues ranging from the Second  Amendment to criminal justice reform.
  38. But on the issue of government violence, there is agreement.  Federal
  39. government power is being aimed at honest citizens,
  40. the liberties of those citizens are being abused and the lives of
  41. those  citizens are being threatened.
  42.  
  43. I will give you just two examples of why this commission is too many
  44. years too  late.
  45.  
  46. At four o'clock in the morning of July 13, 1994, dressed in their
  47. Ninja-style  outfits, agents of the Bureau of Alcohol, Tobacco and
  48. Firearms stormed into the  bedroom of Monique Montgomery, aged 21.
  49.  
  50. The BATF says it was looking for drugs  in the home of the St. Louis
  51. woman, but it found none.   The BATF says it was  looking for illegal
  52. guns, but it found none.  Instead -- after a investigation  that was
  53. six weeks in the making -- it found a woman -- alone and deep asleep
  54. -- in her bedroom.
  55.  
  56. According to press accounts, two agents hit that bedroom with guns
  57. drawn,  shields up and high intensity lights glaring.  The agents
  58. claimed that they  knocked and announced themselves ... before
  59. breaking down the woman's door.   Hearing such a commotion and being
  60. startled as anyone would with such a bizarre  scene at four in the
  61. morning, Miss Montgomery did what most reasonable  Americans would
  62. do.  She armed herself with a firearm she lawfully owned for
  63. personal protection.
  64.  
  65. The agents claim to have, quote, repeatedly identified themselves and
  66. told her  to drop her weapon, unquote.   But this is the same BATF
  67. which set the time for  the raid at four in the morning -- to
  68. maximize the victim's disorientation.  So  the victim had no choice
  69. but to be disorientated and confused.  And, according  to the BATF,
  70. the agent, quoting again, didn't have any other choice, unquote,  --
  71. but to shoot her.
  72.  
  73. And shoot her he did.  Four times.
  74.  
  75. Long before Ms. Montgomery was released from the hospital after being
  76. shot in  the chest and hip, the agent who shot her was back on the
  77. job.
  78.  
  79. And now, quoting from a St. Louis Post-Dispatch  editorial, ATF
  80. officials may  have perfectly good explanations.  But in the wake of
  81. the Branch Davidian raid  in Waco, Texas, ... citizens have reason to
  82. ask two more questions:  Did the  agents handle this raid the right
  83. way?  Has the ATF learned any lessons in  patience?  Unquote.
  84.  
  85. The BATF must learn a lesson, not just in patience, but in
  86. constitutional  rights.   Federal law enforcement -- like state and
  87. local law enforcement --  exists to preserve and protect our
  88. liberties as well as our lives.  The 3.5  Million members of the
  89. National Rifle Association grow increasingly concerned  about the
  90. cavalier attitude of many elements of the Bureau of Alcohol, Tobacco
  91. and Firearms.   The signs of abuse of power are unmistakable.  It is
  92. time for  Americans to read the signs and demand an accounting.

  94. But just as a national commission is too late to help Monique
  95. Montgomery, it is  also too late for Louie Katona from Bucyrus,
  96. Ohio.
  97.  
  98. The Katona family is a poster family for Middle America.  Louie's
  99. wife is a  devoted mother.  Louie himself owns a real estate agency.
  100. He was a part-time  police officer and a full-time community
  101. contributor.  But he is also a gun  collector.
  102.  
  103. Based on a trumped-up charge that he falsified certain BATF forms,
  104. BATF entered  his home.  During the raid, his wife, Kimberly, became
  105. understandably agitated  and upset.  An overzealous agent pushed his
  106. wife against a wall.  Within hours,  Kimberly, then several months
  107. pregnant, began bleeding.   She soon miscarried.
  108.  
  109. Did BATF apologize to this family?  No.  Instead, BATF pressed
  110. criminal charges  against Katona.  This past April, a judge threw the
  111. charges out of court.  The  Katona family has civil action pending
  112. against ATF.
  113.  
  114. The reasons for the Constitution are many, but one primary reason is
  115. to limit  raw government power that we have seen nearly destroy the
  116. Katona family and  nearly kill Monique Montgomery.
  117.  
  118. It is time to readjust the scales of power in this country.  Those
  119. scales must  always weigh in favor of the people's rights, not the
  120. government's power.  For  Monique Montgomery and the Louie Katona
  121. family, the scales of power nearly  crushed them out.  We must right
  122. that wrong.
  123.  
  124. For too many Americans, a national commission on government violenc
  125. is too  many years too late.  Let us not keep Americans -- or  their
  126. constitutional  rights -- waiting any longer.  NRA joins ACLU, the
  127. Citizens Committee for the  Right to Keep and Bear Arms, the
  128. Independence Institute and others in urging  President Clinton -- one
  129. more time -- to right the scales of justice.
